Our Work

We are currently litigating 13 class action lawsuits against corporate landlords with claims seeking to halt profit-prioritizing strategies and seek redress for impacted tenants to alleviate financial burdens responsible for perpetuating housing insecurity, homelessness, and the erosion of affordable housing. Our class action lawsuits collectively cover over 85,000 units across the state. Of the more than 71,000 units across 260 properties represented within the Denver metropolitan area, we estimate more than 18,000 of these households are considered indigent, having a household income that does not exceed 200% of the family federal poverty guidelines.

How we work

Impact Litigation & Class Actions

By employing class action lawsuits against the largest corporate landlords that prioritize profit over tenant well-being and shape industry practices, we strive to hold landlords accountable for each tenant impacted by unlawful and profit-driven strategies that perpetuate housing insecurity.

Class actions allow us to advocate on behalf of thousands of similarly impacted tenants through the filing of one lawsuit, offset the limitations presented by limited legal advocacy, and mitigate the inherent power differential between tenants and landlords, making it financially burdensome for landlords to engage in unlawful practices.

Predatory Eviction, Towing, and Other Practices

Since January 2022, we have been litigating multiple class action lawsuits against Tschetter Sulzer P.C., the law firm responsible for over 50% of evictions in the state, for serial violations to the Fair Debt Collections Practice Act (FDCPA). Tschetter’s predatory eviction strategies have tarnished the eviction and credit records of thousands of Coloradoans. We also have an open case against Wyatt’s Towing, the largest tow company in Colorado.

Mobile Homes & Manufactured Housing

In conjunction with our organizing efforts, we have worked to help residents of mobile home parks enforce the protections of Colorado’s Mobile Home Park Act or “MHPA.” Recognizing the unique percarity of mobile home park residents - who own their homes, but not the land underneath them - Colorado has passed specific protections for mobile home park residents to help ensure landlords are unable to take advantage of residents of naturally occurring affordable housing. These include protections like resident opportunity to purchase, restrictions on new fees, and designation of landlord responsibility for common areas. We are litigating multiple suits to enforce these protections to keep communities safe and affordable and to stop landlords from padding their profits on the backs of working people.

Warranty of Habitability and Maintenance Standards

Given weak regulatory enforcement, many landlords opt to maximize profits by deferring maintenance and neglecting necessary upkeep. This profit-seeking strategy leads to substandard living conditions, such as rodent infestations, structural damage, lack of heating and plumbing, and can ultimately result in condemnation and displacement. Between 2003 and 2013, one in eight rental homes affordable provided to the lowest-income renters were in substandard condition, and by 2013, 11% of these rentals were permanently lost from the housing stock. To maintain the supply of existing affordable housing, it is essential to hold landlords accountable for maintaining the habitability of their properties.

Junk fees and Abusive Security Deposit Practices

With over 51% of Colorado residents already rent-burdened, profit seeking strategies such as unlawful junk, application, and move-out fees, and the unlawful withholding of security deposits is exacerbating financial strain, increasing eviction risk, and reducing the supply of actual affordable housing.Our class action efforts seek to end practices that amplify housing insecurity, and instead we look to return money to renters’ pockets, and clear eviction records and credit reports are essential. By addressing these systemic issues, we can prevent eviction and houselessness, ensuring more residents have access to stable, affordable housing.

Community Organizing Work

At our center, we are clear that legal strategies are never a silver bullet. The best thing that tenants and mobile home residents can do to protect their communities is to organize. If only one or two people stand up to their landlord, they will likely be retaliated against and perhaps evicted, despite the fact that evictions based solely on organizing are illegal. We provide organizing trainings to residents ready to engage their community and stand up to their landlord, from how to conduct one-on-ones, how to start a campaign, to door knocking, to learning how to advocate in front of elected officials. All the tenant protections won in Colorado came from decades of organizing. We are currently partnering with 9to5 Colorado to organize and bring justice to residents living in Fox Ridge Farms Mobile Home Park in Arapahoe County and are working with residents in MonteVista in Denver and 3 Mile Community Park in Garfield County to prepare them for resident ownership.
